I like it that women have separate prisons, restrooms, sports, and the like. I agree that it should be required.

However, I find it awkward that this has to be argued on an “equality” basis. After all, everyone agrees that racial equality forbids separate prisons*, restrooms, sports, and the like. Isn’t equality the same as equality?

Many judges and legislators are untroubled by this paradox, if it is a paradox. But does that show that it isn’t important, or that they are taking a mental shortcut to a desired result? Judges, at least, are not supposed to do the latter.

* Note that “safety” can overrule racial equality in the case of men’s prisons. The nature and limits of the “safety” principle are unexplored.
